Astana May Have Violated French Anti-Doping Laws

Le Monde reports today that the Astana team of Armstrong and Contador may have violated criminal anti-doping laws in France during the 2009 Tour. According to sources close to the investigation, authorities from the Oclaesp, the institution charged with public health investigations in France, found equipment for blood transfusing in the hotel rooms and wastebaskets of the team. Dominique Pérard, the vice-prosecutor in Paris, has deemed the evidence sufficient to open a preliminary inquiry. This move is the first step in France's criminal law procedure.

Under the anti-doping laws passed in France in July 2008, possession of transfusion equipment is a violation of criminal statutes. The WADA code contains a similar prohibition. Investigators also found syringes and needles in the trash bins and currently, the laboratories are working to identify the substances. In particular, they are looking to see if the evidence includes growth hormone. Investigators also seized anti-hypertension drugs. Though these drugs are not prohibited under French law or WADA rules, they are frequently used in connection with blood doping to combat arterial hypertension resulting from transfusions or EPO use.

So far, investigators have identified seven different DNA sequences on the evidence, suggesting that seven individuals, likely riders, used the seized equipment. The French authorities have not identified the individuals as yet, because they need access to blood samples and DNA information held by the UCI. The UCI has not proved willing to release the necessary information, and French authorities and the Cycling Union have battled in recent months over the conduct of doping controls at this year's Tour. The French charged that the UCI showed favoritism toward Astana and in particular, allowed the team extra time to prepare for testing. The UCI has denied the charges and ill-will between the two organizations continues. Le Monde reports that Oclaesp investigators confirmed the delays granted to Astana, and said that they were "sufficient to allow for the dilution of blood."

The investigation originally targetted several teams, but as of now, focuses only on Astana. According to the information uncovered by Le Monde, the prosecutors found D_mediumthe evidence insufficient to open proceedings against any other teams.

So Oclaesp has found a possibly illegal infusion kit. That’s the big news here. The other stuff, the syringes, etc, were known in October I think and there’s nothing illegal with them yet. No illegal substances, specifically HGH, have been found though they have had the time to get DNA profiles on users of the syringes. So unless they find some banned substance those DNA samples go nowhere even if they identify who the users were. That leaves the infusion kit which Johann has already denied is illegal. We’ll see, won’t we?

So to answer umwolverine’s question, it is not at al clear that there’s anything going on here, though the writer of the original article certainly hopes there is.

quick search of From Lance to Landis

reveals quite a discussion of distribution and disposal of medical “products” in the 98 and 99 Postal squads (106-110). The only named sources are Andreu and Emma O’Reilly.

I also remember, but can’t remember where, hearing about either Postal or Discovery (Armstrong/Bruyneel) complaining about having their vehicles followed when they went to dump their trash. (Which sorta begs the question of why they were disposing of their trash separately, but I might be misremembering.)

And if the police want to go further in their investigation

then asking the UCI for access to their samples is just one way of getting access to the DNA of the team. If the UCI refuse then surely the next step in the investigation is to take a sample themselves next time any of those riders are in France, be that for the Etoile de Besseges, Paris-Nice or the Tour itself.

How does an infusion kit differ from a dehydration/IV kit…and what chance is there that either the authorities or the translators are confusing the two or just not being specific?

I wouldn’t be surprised if they were both illegal in France, but it still seems a relevant point.

all dehydration/IV kits are illegal now except in case of extreme medical need, the sort that causes you to drop out of the competition. You’re only allowed to rehydrate the natural way now.

IMHO

I certainly agree this is news, but nothing smells very fishy to me. Medical equipment has plenty of legal uses. And if they were doping during the Tour, I can guarantee you they wouldn’t dump the contraband within 50 miles of their hotel. I bet every Tour hotel has syringes in the dustbins afterward, from every team… from their vitamin shots.

I don’t fault the French authorities from inquiring, that’s their prerogative. I am a little annoyed about targeting one team in the absence of fishier evidence, but that’s what happens to winners nowadays — they bear the highest burden of proving their innocence.

I'd never put my name behind a statement like

“Lance is a doper”, or “Lance never doped”, but I will say that he didn’t finally decide to dope in 2009. Given that, “IF” he did dope in 2009, he’s been doping successfully all along and he’s well practiced in evasion. There is no way that “arrogance” or “carelessness” could be a cause for leaving blatantly damning evidence in hotel waste baskets – I mean seriously. As for the the tolerance of delays and the suggestion that dilution of blood was taking place during the delay, I can’t deny that my mind keeps flashing back to that imfamous “shower” that he took while “credentials were verified” during the out of competition random test last spring.

I’ll assume that “2008” was a typo and you meant “2009”, because that what the article is referring to. Secondly, Alberto was on the team, and would be subject to the same sanctions if he’s found to have been involved. Lastly, you may be right however without even realizing it, because if they are collectively guilty, then neither Lance or Alberto will have to worry about anyone in 2010, because they’d be spectators at best.

though lance made a lot of friends in france in 2009, i think that the ASO may still have it in for him and bruyneel. if they ban them then alberto still gets to ride (sans vino). me, i’d lke to see “alberto and lance, the sequel.” hopefully prudhomme does as well.

i can’t help but feel that the embarassment of a bad decision (not inviting Astana in 2008) was cemented by French pride, and the unwillingness to follow suite after the Italians agreed to invite them to the giro.

here’s a story of vague interest to those tracking doping related deaths. Russian bodybuilder Vladimir Turchinsky dropped dead of a heart attack last week, aged 47, just a few hours after undergoing blood rejuvenation treatment.
