Lawyer for ex-cop videotaped knocking over bicyclist slams victim over 2001 fatal N.C. car crash

A cyclist body-slammed during a protest by a cop was grilled on the witness stand Tuesday about his pot-smoking, getting tossed from the Army and a deadly car accident.

Lawyer Stuart London, who is representing former Officer Patrick Pogan, demanded to know if Christopher Long was stoned when he killed a man in a 2001 highway crash.

"No, I was not," Long said, though he admitted he was thrown out of the Army for smoking weed and still smokes the stuff every day.

London also questioned Long, 31, about a failed marriage and a recent arrest for kicking a side-view mirror off a parked car in Brooklyn.

The biker seemed to shrug off the implication that his drug use or other troubles played any role in his 2008 confrontation with Pogan, which was caught on video.

Pogan, a rookie who has resigned from the NYPD, is charged with assaulting Long during a Critical Mass ride for bikers' rights - and trying to cover it up. He faces up to four years in prison if convicted.

Long - an itinerant gardener living off a $65,000 settlement from the city for Pogan's push - described in court how he veered left to avoid Pogan but that the cop took "large steps to intercept me."

"He hit me on my right side," Long said. "I was tilting and leaning [to the left] ... to avoid hitting him with my bicycle."

He said Pogan taunted him: "Did you think you were going to go right through me? Would you like to try that again?"

Long, who tried to flee after hitting the pavement, was shoved into a police van - where he told Pogan he had herpes.

"I wanted to scare him because he scared me," Long said, admitting it was a lie.
